Wanganui Council to draft new gang patch bylaw

The Wanganui District Council has decided not to appeal a ruling that its gang patch ban is illegal, and will instead write a new gang patch bylaw.

The bylaw was successfully challenged in the High Court by a member of the Hells Angels gang.
The court found that the by-law went too far and did not fully consider people's right to freedom of expression.

Wanganui Mayor Annette Main says the council will ask the central government for financial and legal help in drafting the new bylaw.

She said the new bylaw would address the issues raised in the High Court decision.
"There is clear support from councillors, the police and the Wanganui public that the gang insignia bylaw is a positive step forward in anti-gang legislation," said Main.

"It sends an important message to our community that we are committed to being a place that doesn't tolerate intimidation by gang members."

Main said the new bylaw could be in force by September this year.
