AUSTRALIA'S highest court will decide whether South Australia's controversial bikie laws are valid, but not until after the March state election.
The Full Court of the High Court this morning granted leave for the state to appeal against a ruling by the Full Court of the Supreme Court in September last year, which found the legislation was unlawful.
In a majority ruling, the state's highest court found flaws in a key section of the Serious and Organised Crime (Control) Act and ruled the legislation invalid, after an appeal by Finks Motorcycle Club members Donald Hudson and Sandro Totani.
Under the act, a magistrate is compelled to grant a control order sought by the Police Commissioner and that the person to be subject to the order is not to be informed of the case against them.
Justice David Bleby ruled that part of the legislation breached a "fundamental proposition" of law.
